1Who is responsible

Mark O’Sullivan, trading as Hall Green Chiropody, is responsible for the information held about you.

2What is held

If you get in touch by phone, email or the contact form, I hold your name, your contact details, and whatever you tell me about your feet or your health. People often describe their symptoms in a first message, so health information can reach me before you have been to the clinic. It is treated as confidential from that moment.

If you become a patient, I also hold your date of birth and address, your GP’s details where relevant, your medical history, medications and allergies, clinical notes from each appointment, your appointment history, and a record of payments.

3Why it is held

To assess and treat you safely, to keep the accurate clinical records that registration as a podiatrist requires, to manage appointments, to answer enquiries, and to take payment and meet tax obligations.

Health information is treated in law as a special category, needing extra protection. It is held on the basis that it is necessary for the provision of health care by a registered health professional who owes you a duty of confidence.

You are not sent marketing. Appointment reminders are part of your care.

4Who else sees it

Your clinical information is not shared outside the practice, other than:

• Rushcliff Limited, which provides the PPS booking and practice management system used to hold appointments and patient records
• Bupa and WPA, where you ask for treatment to be billed to your insurance policy, and then only what the insurer needs to settle the claim
• Your GP or another clinician, where a referral is the right next step, which is discussed with you first
• My accountant, for financial records that may include your name and what you paid
• My indemnity insurer, and a regulator or authority, where a claim arises or the law requires it

5How long it is kept

Clinical records are kept for the periods set out in national guidance for health records: 8 years after your last appointment for adults, and until their 25th birthday for patients treated as children. Financial records are kept for 6 years. Enquiries that do not lead to an appointment are not kept indefinitely. Records are securely destroyed once the period ends.

6Keeping it safe

Patient records are held in a password-protected clinical system that only I have access to. Devices are encrypted and kept up to date. Paper records are stored securely at the clinic. If anything ever went wrong in a way that put your rights at risk, you would be told.

7Your rights

You can ask to see the information held about you, have anything inaccurate corrected, ask for it to be deleted, or object to how it is used. Clinical records generally have to be kept for the periods above, but everything else is open to discussion.

Just ask, using the details at the top. There is no charge, and you will get a response within a month. Asking to see your records will never affect your care.

8Complaints

If you are unhappy with how your information has been handled, please tell me first so it can be put right. You can also complain to the Information Commissioner’s Office at ico.org.uk (opens in new tab) or on 0303 123 1113, without raising it with me first.
